1. Who provides this service
These Terms of Service apply to the Intellzia WhatsApp integration operated by Intellzia Solutions LLC, Saudi Arabia (Intellzia, we, us). The integration connects an authorized business’s WhatsApp Business account with its Intellzia business software environment for messaging, customer service and related workflows. Your signed service agreement governs the purchased scope, fees, hosting, support and service commitments. Mandatory legal rights remain unaffected.
2. Acceptance and authorized access
By accepting these terms during onboarding or using the integration, you confirm that you are authorized to act for the business and grant access to its selected Meta assets. You must provide accurate business details, protect login credentials and assign access only to authorized staff. Do not connect another business, phone number or account without permission. Your business retains ownership of its WhatsApp number, Business Account and business content; access granted to Intellzia is for delivering the agreed service.
3. Onboarding and WhatsApp Business App coexistence
Connection uses Meta’s applicable authorization and onboarding flow. Same-number use with the WhatsApp Business mobile app is available only where Meta permits coexistence for the app, business and number. Features depend on permissions, configuration and eligibility. Connecting with an API token alone does not establish coexistence. These terms do not represent confirmation of Meta approval, Tech Provider status or eligibility.
Historical messages or contacts are synchronized only when supported and authorized, subject to the phone owner’s sharing choice and Meta’s limits. Sharing history does not grant marketing consent. Intellzia will not register, migrate or delete your number as an implied consequence of accepting these terms; any such action requires specific authorization.
4. Messaging responsibilities
You must follow applicable law, the WhatsApp Business Messaging Policy, WhatsApp terms and relevant Meta platform rules. Obtain the required recipient opt-in, keep evidence of it and respect requests to stop messages, including STOP or إيقاف. Imported contacts, a prior purchase and access to a phone number alone do not establish permission for marketing.
Business-initiated messaging must use approved templates where required. Free-form API replies are subject to Meta’s customer-service window; outside that window, approved templates are required. A manual send in Intellzia still uses the API and follows the same rules. Bulk campaigns and automated replies must follow these requirements. Do not use the service for spam, impersonation, unlawful content, prohibited goods or attempts to bypass platform restrictions.
5. AI replies and automation
Where AI or automation is enabled, the business is responsible for its instructions, source information, recipient permissions and appropriate human oversight. AI output may contain errors; review important or sensitive responses. Provide recipients with a clear way to reach a human. Do not use automated output as the sole basis for decisions with significant legal, financial or other effects on a person. Do not submit secrets or unnecessary sensitive information to AI features. Processing by enabled AI providers is described in the Privacy Policy and the applicable service arrangements.
6. Data use and privacy
The integration processes permitted business/account identifiers, connected numbers, authorization details, contacts, message content and attachments, timestamps, templates, delivery events, authorized history and support records as needed for the enabled service. We use data for the agreed messaging workflows, account management, support, security and compliance, subject to our Privacy Policy and applicable agreement.
The customer generally determines the purposes of processing its customer conversations; Intellzia processes those records on its instructions. The business must publish its own privacy information and obtain required permissions. Intellzia remains responsible for data it processes for its own business purposes. Do not share one customer’s conversation with another customer. Access and retention must be proportionate to the service and applicable obligations.
7. Fees and third-party services
Intellzia subscription, implementation, hosting and support charges are set in your proposal or service agreement. Meta messaging and other third-party charges may apply separately unless included expressly. Their pricing, limits, approval decisions and availability can change. No unlimited free messaging, guaranteed message delivery or particular Meta approval is promised. Meta and WhatsApp operate their own services under their own terms; Intellzia cannot override their policies or restore access they have restricted.
8. Security and acceptable use
Use the service only for your authorized business and agreed purposes. Do not disclose passwords, API tokens, app secrets or verification codes; attempt unauthorized access; defeat company access restrictions; or disrupt the service. Report suspected compromise promptly to hello@intellzia.sa. We may restrict a connection where reasonably necessary to address a security incident, unlawful use, platform suspension or loss of authorization, subject to applicable law and contractual obligations.
9. Disconnection and deletion
You may stop using the integration, withdraw authorization and request deletion through the available connection controls or hello@intellzia.sa. See our Data Deletion Instructions for identification, scope and follow-up. Disconnection stops integration access; it is separate from erasing stored data.
Removing this integration does not itself delete your WhatsApp number, Business Account, phone app or copies held by Meta or recipients. Separate accounting and CRM records, necessary legal records and backups require review under the Privacy Policy and applicable obligations. We will explain any lawful retention affecting your request.
10. Service limits and responsibility
Features depend on the purchased scope, supported software, Meta permissions and third-party availability. You are responsible for your content, recipient permissions, staff access and business decisions. Intellzia is responsible for its obligations under applicable law and the service agreement. Availability commitments, remedies and any agreed liability limits are governed by that agreement; these terms do not exclude liability or rights that cannot lawfully be excluded.
11. Changes and governing law
We may update these terms when the service, platform rules or legal requirements change. This page shows the revision date; material changes will be communicated and additional acceptance obtained where required. Updated terms do not remove accrued rights. Unless your signed agreement lawfully provides otherwise, these terms are governed by the laws of Saudi Arabia and disputes are subject to the competent Saudi courts.
